Accepting these terms
These Terms of Service form an agreement between you and Orbace Technologies LLC (“Orbace,” “we,” “us,” or “our”) governing orbacesudoku.com, Orbace Sudoku applications, and related services that link to these terms (collectively, the “Services”). By accessing or using the Services, you agree to these terms and our Privacy Policy. If you do not agree, do not use the Services.
App-store terms may also apply. If a platform’s mandatory terms conflict with these terms, the platform terms control only to the extent required for your use through that platform.
02 · Eligibility
Who may use Orbace
You must be legally able to enter this agreement. If you are under the age of legal majority where you live, a parent or guardian must review and accept these terms for you. Connected accounts are not intended for children under 13 without any consent required by law.
You may use the Services only where permitted by law and in accordance with applicable sanctions, export-control, and consumer-protection requirements.
03 · Accounts
Accounts and display names
Some features work without an account; others—such as synchronized progress, public Su-Pu records, rankings, or tournaments—may require one. You are responsible for protecting your device and sign-in credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.
Provide accurate information and keep it current. Display names may not impersonate others, contain unlawful or abusive material, advertise without permission, or mislead players about affiliation with Orbace. We may change or remove a display name that violates these rules.
04 · Fair play
Ranking and tournament integrity
Personal experimentation is welcome. Public competition must be fair. Unless a specific event expressly allows it, you may not:
- use automated solvers, scripts, bots, macros, modified clients, or external answer services;
- share or obtain answers during an active ranked puzzle or tournament;
- manipulate device time, network requests, scores, timers, puzzle records, or Su-Pu data;
- operate coordinated or duplicate accounts to influence rankings or rewards;
- exploit a bug after you know or reasonably should know it affects fair results; or
- harass players, publish harmful content, or interfere with the Services.
We may review unusual results using game and technical signals, remove ineligible records, correct rankings, restrict event access, or suspend accounts. You may appeal a decision through the contact information below.
05 · Content
Orbace content and content you share
The Services—including software, puzzles where owned or licensed by Orbace, designs, text, illustrations, branding, and documentation—are owned by Orbace or its licensors and protected by intellectual-property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services as provided. You may not copy, scrape, republish, sell, reverse engineer, or create a competing dataset from the Services except where law expressly permits it.
You retain rights you have in content you submit, such as a profile image, comment, or voluntarily shared Su-Pu annotation. You grant Orbace a worldwide, non-exclusive, royalty-free license to host, reproduce, format, display, and distribute that content only as reasonably needed to operate and promote the feature in which you shared it. You represent that you have the necessary rights and that the content is lawful.
Feedback may be used without restriction or compensation, but we will not publicly attribute private feedback to you without permission.
06 · Purchases
Subscriptions and purchases
If Orbace offers a paid feature, the price, billing period, included benefits, and renewal terms will be shown before purchase. App-store purchases are billed and refunded by the applicable platform under its rules. Taxes may apply. Unless required by law or the platform’s policy, used digital services are not refundable.
We may change future pricing or discontinue an offer, but will provide any notice required for an existing subscription. Cancellation stops future renewal; access generally continues through the paid period unless stated otherwise.
07 · Service
Updates and availability
We work to provide a reliable experience, but the Services may change, pause, or become unavailable because of maintenance, security, provider outages, legal requirements, product decisions, or events beyond our control. Features may differ by platform, version, region, account status, or device.
We may correct puzzle, scoring, ranking, or content errors. We do not promise that every feature will remain available permanently or that offline information can be recovered after deletion, device loss, or app removal.
08 · Enforcement
Suspension and ending use
You may stop using Orbace at any time and may request deletion of eligible connected-account information as described in the Privacy Policy. We may limit or suspend access for a material or repeated violation, security risk, legal requirement, nonpayment, or threat to players or the Services. Where reasonable, we will provide notice and an opportunity to appeal.
Provisions concerning ownership, licenses already granted, disclaimers, liability, disputes, and obligations that by nature should survive will continue after use ends.
09 · Responsibility
Disclaimers and liability
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Orbace disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these terms limits rights that cannot legally be waived.
To the fullest extent permitted by law, Orbace Technologies LLC and its officers, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, revenue, opportunity, or goodwill arising from the Services. Orbace’s aggregate liability for a claim will not exceed the greater of the amount you paid Orbace for the affected Service during the preceding twelve months or US $100, except where a different limit is required by law.
10 · Legal terms
Governing law and changes
These terms are governed by the laws of the State of Michigan and applicable United States federal law, without regard to conflict-of-law rules. Courts located in Michigan will have jurisdiction except where consumer law gives you the right to bring a claim elsewhere.
If part of these terms is unenforceable, the remainder remains effective. Failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent; Orbace may transfer it as part of a business reorganization or sale.
We may revise these terms when the Services or legal requirements change. We will update the date above and give additional notice when required. Continuing to use the Services after revised terms take effect constitutes acceptance, except where law requires express consent.
